A Folsom man has been arrested following an investigation of a road rage incident and the brandishing of a firearm that occurred in Historic Folsom last month.

According to a Folsom Police report released today, patrol officers initially responded to the area of Riley Street and Sutter Street back on July 16 for a report of a subject pointing a firearm at an occupied vehicle after what was described as a road rage incident. The incident was caught on city traffic cameras, and the suspect vehicle was later identified.

Through the investigation, Detectives from our Special Investigations Unit (SIU) identified the suspect as 41-year-old Kevin Smithson of Folsom. With the assistance of the Folsom Police Department SWAT team, Detectives served a search warrant on Wednesday in the 100 block of McCormick Court in Folsom.

During the search warrant, the firearm, later determined to be a paint ball gun, was recovered from the back seat of the same vehicle identified in the original road rage incident. Detectives also located firearms in the residence that were defined by California law as “Assault Rifles.”

According to the report Smithson was booked at the Sacramento County Main Jail on firearms charges.

*During further court proceedings, the Sacramento District Attorney’s offices declined to file brandishing charges but filed a possession of an assault weapon at a later time, according to information provided by Lt. David Canepa of the Folsom Police Department. This information was added in an update on July 30, 2024.
