SACRAMENTO COUNTY – A 41-year-old Sacramento County man has been arrested on suspicion of  six felony charges, including kidnapping, rape by force and assault with a deadly weapon Sacramento County Sheriff’s office.

According to the reports, on Friday, March 10, 2023, a Sacramento County female resident was approached and kidnapped by force by a former acquaintance that was later identified as 41-year-old Samuel Garcia-Gutierrez.

Garcia-Gutierrez reportedly entered the victim’s vehicle, presented a firearm and forced the victim to drive to his residence with him. Garcia-Gutierrez kept her there against her will for several hours and sexually assaulted her. 

The victim eventually was able to leave Garcia-Gutierrez’s residence and was taken to safety by family members who contacted the Sacramento County Sheriff’s Office.

Detectives from the Sheriff’s Office, Sexual and Elder Abuse Bureau (SEAB) took over the investigation and a search warrant for Garcia-Gutierrez’s residence which was determined to be in Rio Linda.

In the morning hours of Saturday, March 11, with the assistance of the Sacramento Sheriff’s Office Special Enforcement Detail (SED), the search warrant was served at the residence and Garcia-Gutierrez was taken into custody without incident at that location. 

Evidence was located inside the residence during the search which corroborated the victim’s statement to detectives.  Many specific details of the incident and the case remain confidential to protect the victim’s privacy as well as the investigation into the incident.

Garcia-Gutierrez was arrested and transported to the Sacramento County Main Jail, where he was booked for PC 209 (Kidnapping with the Intent to Commit Rape); PC 236 (False Imprisonment); PC 245(a)(2) (Assault with a Firearm); PC 261(a)(2) (Rape by Means of Force, Violence, Duress Menace, or Fear) amongst other charges. Garcia-Gutierrez remains in custody until his scheduled court appearance on Tuesday, March 14 at 1:30 pm. He is currently ineligible for bail.
